Terms & Conditions

OBJECT

These General Contract Conditions (hereinafter "GCC") concern the offer and sale of the Services (as defined below). The user who uses the Services is required to carefully read and approve, by selecting the appropriate box made available to him during the purchase process, these GCC. The Services are provided by Aditus srl, based in Turin, via Sebastiano Caboto 35, registered in the Turin company register at no. TO-1089615 tax code and VAT number no. 09896500015 (hereinafter Aditus). The Services (as defined below) will be provided using special software owned by Aditus included on the website www.aditusculture.com. The Services have as their object: the remote trading of access tickets to the initiatives published on the aditusculture.com portal, i.e. documents, including in digital format, which legitimize the bearer of said tickets to access the premises and/or services indicated on the documents themselves and; the reservation of access tickets to an event and/or services, usable on certain dates and times, made available by Aditus (the "Access Tickets"); the purchase of specific services (for example: guided visits to cultural sites, guided tours, etc.); The operations identified in the previous points, individually and/or jointly below will be defined as the "Service", or the "Services".

SCOPE OF APPLICATION

The offer and sale of the Services constitute a distance contract governed by Chapter I, Title III (articles 45 et seq.) of the Consumer Code and by Legislative Decree 9 April 2003, n. 70, containing the regulation of electronic commerce. The Aditus Services are offered for sale only to Customers who are (a) consumers (pursuant to Legislative Decree no. 206/2005), i.e. any natural person acting for purposes unrelated to entrepreneurial, commercial, artisanal or professional activity possibly carried out; (b) adults (pursuant to the laws of the respective countries) (hereinafter the “Customers” or the “Customer”). Aditus has the right to refuse to process orders that do not comply with these GCC. The online publication of these documents and the confirmation of the purchase order for the Services (hereinafter "Purchase Contract") provided by Aditus to the Customer are valid as "confirmation of the contract concluded on a durable medium" pursuant to art. 51, paragraph 7 of Legislative Decree no. 206/2005 (“Consumer Code”).

BOOKING PROCEDURES

In compliance with Legislative Decree 9 April 2003, n. 70 containing provisions on electronic commerce, Aditus informs the Customer that to conclude the Purchase Contract through the sales portal, the latter, after registration, must select the Service and complete the online form, which must be considered as a proposal contractual (hereinafter the “Order Form”). The Order Form consists of a page that allows the Customer to provide payment details. The Order Form also includes the main characteristics of the Service ordered, the unit price (including VAT) and a link to the GCC. To send the details and complete the Order Form, the Customer, if not previously registered, must provide his/her personal data by completing the registration form. The personal data of each individual for whom the Customer is entitled to purchase an Access Ticket to which a reduction/free charge is applied (hereinafter the "Admission Ticket Holder") will be requested when adding the Services to the cart. The Customer declares and guarantees that all information relating to personal data provided in the Order Form is updated, complete, accurate and truthful. The Customer authorizes Aditus to verify the correctness of the personal data and any other information provided and undertakes to collaborate with Aditus during such checks. By sending an Order Form to Aditus, the Customer unconditionally accepts and undertakes to comply with the provisions of these GCC. The Order Form is stored in the Aditus database for the time necessary to process the Customer's order and for the time required by law.

ENTRY TICKETS AND EVENTS

The Customer or Access Ticket Holder must have a valid Access Ticket to enter the cultural site and/or to use the services offered by Aditus (hereinafter, jointly, "Cultural Initiative"). The rules made known in relation to the individual cultural initiative apply to them. The Access Ticket must be purchased through the aditusculture.com portal. In the event that the Access Pass has been purchased by parties other than those indicated above or if the Access Pass has been lost, stolen, duplicated or obtained in conflict with these provisions, the Access Pass Holder may not be authorized by Aditus to access the site of the Cultural Initiative or may be forced to abandon it. Aditus will not replace the Access Tickets to the selected events delivered to the Customer, in the event that such Access Tickets are lost, lost, damaged, damaged, destroyed or stolen. The Access Ticket cannot be transferred by the Customer for consideration nor can it be the subject of intermediation. Aditus may at any time cancel, upon request of the Authorities responsible for the protection of public order and safety, an Access Ticket even if already issued or a Purchase Contract already carried out both for technical and/or organizational reasons and where problems arise regarding upon actual payment of the Access Ticket by the Customer. Aditus reserves the right to refuse or cancel orders that come (i) from a Customer with whom they have an ongoing legal dispute; (ii) by a Customer who has previously violated these GCC and/or the conditions and/or terms of the Contract; (iii) by a Customer who has been involved in fraud of any kind and, in particular, in fraud relating to credit card payments; (iv) from Customers who have provided false, invented, imaginary, incomplete or otherwise inaccurate identification data and/or in any way not corresponding to the truth or referring to third parties. Availability of Entry Tickets With regard to the Access Tickets that can be purchased through the sales portal, Aditus reports and the Customer acknowledges and recognizes that: a plurality of users may attempt to purchase the same category of Services in relation to the same Initiative Cultural (“Same Access Ticket”) at the same time; pressing the “Pay now” button generates a request to the Aditus server (“Server”); all requests to the Server generated by pressing the "Pay now" button and relating to the same service are processed in chronological order, based on the time of arrival of the request to the Server; the purchase of the category of Services selected by the Customer, by pressing the "Pay now" button, can therefore only take place if, at the moment in which the request generated by the pressing of this button reaches the Server, there is still availability of the category of services requested, taking into account the actions performed by other Customers whose request relating to the same service arrived at the Server at a time prior to that of the Customer. Duration of reservations. Aditus allows the Customer to have an unlimited period of time available to complete the purchase process of the booked Services (hereinafter the "Booking Time”). Payment instruments Payment for the Services is permitted using credit cards belonging to the VISA, MASTERCARD, AMERICAN EXPRESS circuits. The accepted credit cards are indicated in the "Payment Options" phase of the purchase process. The total amount owed by the Customer to Aditus will be charged at the time the order is sent. Payment takes place through a secure payment service that involves the use of the TLS security protocol. Confidential credit card data (card number, expiration date, security code) are encrypted and not managed directly by Aditus. Upon confirmation of the Order Form, the amount relating to the access tickets in a confirmed state at the time of the order will be charged. The charging of any other services in a different status (Pending) will take place exclusively upon confirmation of the Service. In case of payment by credit card, the data will be stored by Stripe upon confirmation of the order and used to carry out subsequent transactions. The amount charged will be equal to the cost of the service purchased together with the related commissions. In the event of termination of the Purchase Contract and in any other case of refund, for any reason, the refund amount will be credited to the same payment method used by the Customer for the initial transaction; if this is not possible, the refund will be made by bank transfer. Aditus will ask the Customer for the bank details necessary to make the refund. Any commissions relating to the transaction carried out will not be included in the refund. The Access Ticket: i) has a unique code which will be detected directly at the access control, ii) in case of a non-group access ticket with a pre-established date and time it allows access to 1 person on the date and time indicated in the ticket itself , iii) in case of a non-group entrance ticket with an open date and time it allows access to 1 person within 6 months from the date of issue of the ticket itself, iv) in case of a group entrance ticket with a pre-established date and time allows access to the number of people for the date and time indicated in the ticket itself, v) in case of open date and time group tickets allows access to the number of people indicated in the ticket within 6 months from the date of issue of the ticket itself, vi) in case of a nominative access ticket, entry will only be allowed to the person holding the ticket for the date and time indicated in the ticket itself and for a number of times indicated in the access ticket, vii) in case of a reduced or free admission ticket it will be necessary contact the reception staff to confirm ownership of the reduction or free ticket which must be demonstrated by showing the relevant document, viii) is not refundable.

PRICE OF ACCESS TICKETS

The price of the Access Ticket is the one communicated by Aditus at the time of closing the purchase of the Service by the Customer. Any lower price that, following purchase by the Customer, is applied by Aditus to Services of the same type or with regard to Cultural Initiatives to be held on a particular date, will not give the Customer the right to a refund of the difference. The price of the Access Tickets, as well as the commission costs, as well as any other price displayed on the Site must be considered inclusive of applicable VAT. In the case of Cultural Initiatives proposed to the Customer via a personalized quote, the price will be communicated privately to the Customer after receipt of a specific information request form completed by the Customer and received by Aditus.

DELIVERY METHODS OF ACCESS TICKETS

The purchased Services are delivered to the Customer in digital ticket format and can be presented by the Access Ticket Holder in paper format or in digital format from their mobile device. The access control system or the staff responsible for carrying out the Cultural Initiative will authorize the entry of only 1 Access Ticket equivalent to 1 single QR code. Any photocopies and/or fraud resulting from improper use of the same will be punishable by law and not attributable to Aditus. Aditus will under no circumstances allow access to any duplicate Entry Tickets.
